I Work As An Office Administrator

I had an absent seizure at work a week ago. The HR department is looking into okaying my return. They were waiting on my doctors note. They seem to be stalling. This is not a paid leave. My doctor has cleared me. Its been 7 working days. I can not drive at this point
What are my legal rights? Can I get fired? Can they change the job description so I don't fit the requirements for the position anymore?

@A MyEpilepsyTeam Member for vimpat at least it does seem rather high. I only take 50mg twice a day, but then again, every case is different. The spike in lamotrogine seems risky to me, given the rash it could cause. But I'm no doctor or pharmacist. You should keep track of your side affects as they happen and document them as precisely as you can.

@A MyEpilepsyTeam Member, you say you don't know. Actually, you will know if you keep a diary of how you are feeling before you take your meds and after. That way, your doctor has something to go by to make adjustments on your treatment.

I would think you are protected by the Americans with Disabilities Act, but if you are part of a union they would certainly have your back. This is the kind of thing labor unions were made to fight against.

I didn’t practice in employment law. But I have filed an accommodation request before back when I worked in a firm.

Not defending your HR department, but it’s a lot of paperwork. Even then, some HR speaks with counsel before dealing with issues related to disabilities and or accommodations.

If you live in California, you can go to the CRD’s website for resources related to employee and employer rights.

Yes I am, you can work on having ssi, make sure you look into your rights and all the stuff that goes with working if you decide to work, and remember the FMLA part, it's a law in the US, in all jobs and business, look it up on your phone, computer,etc, that do not forget to do. And is for people like us and disabilities, my opinion.
