HIPAA Violation - What Information Can Be Disclosed?

My doctor approved my getting my license back about six months ago. Illinois requires a medical form from the physician. The form says it is confidential so I completed it no questions asked.

Today, I get a request from my auto insurance company for a medical release from my doctor related to my medical condition. I never disclosed the epilepsy to the auto insurance company and I have never had a seizure while driving. How would the auto insurance company even know to request this information… read more

@A MyEpilepsyTeam Member I have notified the state. All of those things have crossed my mind. The form I submit to the state with MY medical information is CONFIDENTIAL. If you sign a form that says confidential, why would anyone believe that information would be released?

Next year (as usual) I'm keeping the same insurance company, get ppo but my monthly premium went DOWN by $3.00... hahaha.. What's up with that???

The ins company pulls your driving records. it shows you have a medical release on file so its requested by them, nothing to do with confidential. They asked YOU. . My suggestion to anyone who is attempting to get driver privileges back, Keep your insurance policy ! Just "suspend the coverage" dont close it. Closing it means you "start from scratch" as far as they are concerned with higher rates to start. all you need is a few dollars in the account to keep an account open but coverage "not active" and no cost.

You had to be seizure free for a year. At that time, I only had seizures in my sleep, never awake and yes, I rarely had seizures at that time so please don't judge me. I do not drive now Judge Judy...
